The grounds for deferral from conscription during mobilisation are set out in Art. 23 of the Law of Ukraine "On Mobilisation Preparation and Mobilisation", and the procedure is set by Cabinet of Ministers Resolution No. 560. Some deferrals can be arranged online, but in practice they are often blocked by incomplete documents, discrepancies in registers or differing interpretations of the rules.
We check whether you have grounds for deferral, how to confirm them and when the deferral expires. We help employers with the reservation (bronyuvannia) of employees: from obtaining critically important enterprise status to submitting lists. The conditions change often, so we work with the current wording on the date you contact us.
When to seek help
- You care for a relative with a disability or are raising a child alone
- You have three or more children or a child with a disability
- You are studying, work at an educational institution or have another ground under Art. 23 of the Law
- The Territorial Recruitment Centre (TCC/ТЦК) refused a deferral or does not respond to your application
- Your deferral is about to expire and has not been extended
- A company needs to reserve employees or obtain critically important status
What the lawyer does
Checking the grounds
We compare your situation with the list of grounds in Art. 23 of the Law and Cabinet of Ministers Resolution No. 560, and assess which documents are needed and whether there are risks of refusal.
Document package
We explain where and in what form to obtain certificates, check their content and prepare the application, to reduce the risk of it being returned for revision.
Submission and monitoring
We help submit documents in the way provided by the current procedure, online or via the TCC, and monitor deadlines to respond promptly to delays.
Employee reservation
We analyse whether the company can obtain critically important status, prepare documents and help compile and submit lists of employees for reservation.
Challenging a refusal
If a refusal is unlawful or there is no decision, we prepare a complaint and a claim to the administrative court and represent you in the case.
Documents to prepare
- Passport, taxpayer identification number (RNOKPP/РНОКПП) and military registration document, including from the Reserv+ app
- Documents on the ground: children's birth certificates, disability documents, certificates of study or employment
- Documents on family composition and the absence of other persons who can provide care
- Previous TCC decisions granting or refusing a deferral
- For reservation: the company's constituent documents, staff list, decision on critically important status

- A list of documents and a ready application
- For businesses: a document package for employee reservation
- A complaint or claim in the event of refusal
Frequently asked questions
Who is entitled to a deferral from mobilisation?
The list of grounds is in Art. 23 of the Law of Ukraine "On Mobilisation Preparation and Mobilisation": among others, temporary unfitness for health reasons, caring for family members with disabilities, having three or more children, studies and certain types of work. Each ground has its own conditions, and the rules change regularly, so we assess your situation under the current wording.
Can I get a deferral online?
Some deferrals can be arranged via the Reserv+ app, and some are extended automatically based on state register data. If the registers lack the necessary data or it is inaccurate, an online application may not work. Then paper documents will be needed. We will advise which route suits you.
How does reservation differ from deferral?
A deferral is granted because of a person's personal circumstances, such as family or health. Reservation is tied to employment: an employer with the relevant status reserves an employee for a set period. If the person leaves the job or the company loses its status, the reservation ends, and the question of deferral has to be dealt with separately.
