A Military Medical Commission (MMC/ВЛК) decision determines whether a person is fit for service and where exactly they can serve. An opinion reached hastily, without taking existing diagnoses into account or ordering the necessary examinations, affects mobilisation, transfer and discharge.
Orders and refusals by military units can also be appealed: regarding transfer, leave, discharge or the issue of documents. We check decisions for compliance with the Regulation on Military Medical Expertise and other acts, prepare complaints to higher MMCs and military authorities and, if necessary, a claim to the administrative court.
When to seek help
- The MMC found you fit, although you have chronic illnesses confirmed by documents
- Your medical records were not taken into account, or you were not referred for additional examination
- The examination was a formality, without the necessary specialist doctors
- The commander refused a transfer, leave or a certificate without proper justification
- Your report (raport) was left without consideration or reply
- You are being transferred to a unit that does not match the MMC fitness opinion
What the lawyer does
Analysis of the MMC decision
We compare diagnoses, examination results and the commission's opinion with the Regulation on Military Medical Expertise and the schedule of illnesses, and identify procedural violations.
Medical records for review
We advise which examinations and specialist opinions are worth obtaining, so that the position is based on a complete medical picture.
Complaint to a higher MMC
We prepare a reasoned complaint to a higher-level standing MMC or the Central MMC demanding that the decision be reviewed or a repeat examination ordered.
Appealing unit orders and refusals
We draft reports, complaints to higher command and advocate's requests to obtain a written, reasoned decision.
Claim to the administrative court
If the out-of-court route has not worked, we prepare a claim and, if necessary, an application for interim measures, and represent you in court.
Documents to prepare
- The MMC decision or certificate you are appealing
- Medical records: discharge summaries, examination results, doctors' opinions
- The MMC referral and the documents you submitted to the commission

- Military registration document or service member ID
What you get
- An opinion on violations during the examination or decision-making
- A complaint to a higher MMC or military authority
- A statement of claim and representation in the administrative court
- Recommendations on medical records for a repeat examination
Frequently asked questions
Where can I appeal an MMC decision?
The decision can be appealed to a higher-level MMC, including the Central Military Medical Commission, or to court. The choice depends on the nature of the violations and how quickly a decision is needed. These routes can be combined: a complaint to a higher commission does not deprive you of the right to go to court.
Does appealing an MMC decision suspend being sent to a unit?
The complaint itself does not automatically suspend the decision. In court you can ask for interim measures, but the court decides this based on the circumstances of the specific case. That is why it is worth acting as early as possible, before being sent to a training centre or a unit.
Can I undergo the MMC again?
Yes, the Regulation on Military Medical Expertise provides for repeat and control examinations, including by decision of a higher MMC or due to a change in health. We will advise which medical records to prepare and how to draw up the application so that the new data is taken into account.
